- These Rules may be cited as the "Mailing Operator and Courier Service Rules, 2013".

- "Economic Code" — the economic code allotted by Government in favour of the Licensing Authority, or the economic code of the Bangladesh Posts Department. "Permit", "Act", "Courier Service", "Customer", "Chairman", "Tofsil", "Prohibited Goods", "Ministry", "Mailing Operator", "Licence", and "Licensing Authority" are defined here.

- Nothing in these Rules applies to bodies carrying the mail-bags of the President, Prime Minister, diplomatic missions, or the armed and law-enforcing forces.

- A Chairman (Joint Secretary or above from the Ministry), a Deputy Secretary or above from the Ministry, and an Additional Director General of the Posts Department as Member-Secretary. Office in Dhaka.

- Grant licences and agency permits, set service standards, mediate disputes, levy administrative fines, hear complaints, conduct inspections, recognise top performers, and ensure transparency and accountability.

- The Authority may collect compensation fees imposed by Government on operator services in connection with the postal-service delivery, and determine the recovery method.

- The Authority may, by special or general order, constitute one or more advisory committees comprising experienced practitioners and trade-association members.
- Bidhi 9. Assistance from operators · সহায়তা গ্রহণ
- The Authority may obtain assistance from any licensed mailing operator or courier service establishment for the discharge of its functions.
- Bidhi 10. Liquidation & receiver appointments · অবসায়ন
- On business closure or insolvency, the Authority may, by court order, appoint a receiver or administrator.
- Bidhi 11. Application for a licence · লাইসেন্সের জন্য আবেদন
- No establishment may operate without a licence. Applications use Tofsil-1; an undertaking in Tofsil-2 plus the documents in Tofsil-3 must accompany the application. After scrutiny, the applicant is directed to deposit the fee from Tofsil-7 and provide a bank guarantee for the prescribed security deposit.

- Every operator already running on the date these Rules take effect must apply for a licence within 3 (three) months. Late filing carries a delay fee of BDT 5,000 and an additional 45-day window; thereafter, BDT 1,000 per working day.

- Each licence may carry conditions covering display of the licence at offices, prohibition on closing operations while customer claims remain unsettled, customer-friendly conduct, complaint resolution, non-use of the licence as loan collateral, non-transferability, prohibition on parallel postal services, ban on carrying cash or foreign currency inside packets, ban on prohibited goods, and obedience to directions from time to time.

- A licensed operator may run business through agents subject to a written contract; agents must follow the operator licence conditions and may not appoint sub-agents.
- Bidhi 15. Business areas · ব্যবসায়ের ক্ষেত্র
- Licensed operators may run document service, parcel service, logistics service, delivery service, express service, specialised and premium postal services, and any other business approved by Government.
- Bidhi 16. Directions to be followed · অনুসরণীয় নির্দেশাবলী
- Operators must publish a rate-chart booklet, follow association-issued pricing guidelines, notify the Authority of any change in address of central office, branches, or agencies; display service hours at booking offices; notify the Authority in writing of any price-rate change; notify before public-share offerings; file annual accounts (revenue, expenditure, profit-loss); train and uplift staff; observe foreign exchange and customs directions for international and on-board operations; provide swift handover and clearance of inbound goods at land/sea/airports; and ensure salary, welfare, group insurance, and other safety-net benefits to employees.

- Booking is on a 3-page declaration prescribed by the Authority — one copy to customer, one attached to parcel, one retained at office. Operators must deliver to the correct addressee in time. Compensation for loss/destruction is paid per the operator policy. False declaration shifts liability to sender/recipient.
- Bidhi 20. Investigation of complaints · অভিযোগের তদন্ত
- Written complaints are recorded in a register. Within 3 working days the Chairman constitutes an investigation committee of one or more officers, which begins work within 7 days. Final report within 15 days; supplemental report within 10 days.
- Bidhi 21. Administrative fines, suspension · প্রশাসনিক জরিমানা, লাইসেন্স স্থগিতকরণ
- On a finding, the Authority issues a show-cause notice; within 30 days the establishment head or representative must appear to provide an answer. Hearing may be extended 15 working days. The Authority may impose administrative fines or issue appropriate orders.
- Bidhi 22. Penalty · দণ্ড
- Failure to deposit a fine within the prescribed period, or non-appearance under Bidhi 21 or 23, is treated as an offence under section 58 of the Post Office Act 1898 and is triable accordingly.
- Bidhi 23. Review · পুনর্বিবেচনা
- A petition for review may be filed before the Secretary of the Ministry of Posts and Telecommunications within 30 days of the administrative-fine order. Within 15 days the operator/representative must be heard. Decision delivered within 7 working days; the review decision is final.
- Bidhi 24. ICT use & application · তথ্য ও যোগাযোগ প্রযুক্তির ব্যবহার
- All notices, orders, and directions issuable under the Act and these Rules may be communicated electronically and acted on with Government approval. The Information & Communication Technology Act 2006 and its sub-rules apply where applicable.

- Where any provision is ambiguous, Government may, by Gazette notification, issue explanations or interpretive directions to harmonise the provision with the Act and other rules.

- Bidhi 27. Repeal & savings · রহিতকরণ ও হেফাজত
- S.R.O. ২৮৮-আইন/২০১১ dated 13 September 2011 is hereby repealed; orders, directives, and proceedings issued under it shall be deemed to have been issued under these Rules.
